Welcome to Kendra’s Luscious Treats! These Terms of Service apply to your use of our website and purchases made through it. By placing an order, you agree to these terms and the policies presented before checkout.

1. Website Use

You agree to use our website for lawful purposes and provide accurate information when placing an order. You must be legally able to enter into a purchase agreement or have permission from a parent or guardian.

You may not use our website to commit fraud, interfere with its operation, or access information without authorization.

2. Our Products

We offer homemade cookies and other baked treats. Because our products are handmade, slight variations in size, color, decoration, and appearance are normal. Product photos are examples; the description and options selected at checkout determine what is included in your order.

Flavors, products, and quantities are subject to availability.

3. Ingredients & Allergies

Please review product descriptions and ingredient labels before consuming our products.

Our products may contain or come into contact with allergens, including milk, eggs, wheat, soy, peanuts, tree nuts, and sesame. We do not guarantee an allergen-free environment.

If you have an allergy or dietary restriction, contact us before ordering so we can discuss ingredients and preparation practices. Ingredient information does not constitute a guarantee that a product is safe for a particular allergy.

4. Orders & Payment

Full payment is required at checkout unless we agree to a different arrangement in writing.

Please review your items, quantities, selected options, contact information, and fulfillment details before submitting your order.

An automated order receipt acknowledges that we received your order. If we cannot fulfill it because of availability, capacity, a listing error, or another issue, we will contact you promptly and refund any amount paid for items we cannot provide.

5. Prices & Promotions

Prices are listed in U.S. dollars unless otherwise stated. Applicable taxes and shipping or delivery charges will be shown before you complete checkout.

Prices and promotions may change for future purchases. Promotional codes are subject to their stated conditions and cannot be combined unless expressly allowed.

If a pricing or listing error affects an existing order, we will contact you before proceeding. You may accept the corrected details or cancel the affected items for a refund.

6. Cancellations, Returns & Refunds

Our Return & Refund Policy explains cancellation deadlines, order changes, and how we handle damaged, incorrect, or missing items.

Because our baked goods are perishable, we do not accept physical returns or exchanges. This does not prevent refunds or other remedies for defective products, fulfillment errors, or situations covered by applicable law.

Custom and large event orders may have additional terms provided and agreed to before payment.

7. Pickup, Delivery & Shipping

Available fulfillment methods and charges are shown during ordering. Our Shipping Policy provides additional details for shipped orders.

Customers are responsible for providing accurate addresses and collecting pickup orders at the agreed time. Please contact us promptly if your plans change.

Carrier delivery dates are estimates unless expressly guaranteed. If we cannot ship within the promised timeframe, we will notify you and provide any delay-consent or cancellation options required by law.

8. Product Care

Please bring delivered products indoors promptly. Product quality can be affected by heat, moisture, extended storage, or improper handling after receipt.

9. Custom & Event Orders

Custom requests, quantities, event dates, and special arrangements must be confirmed by us in writing. Submitting a request does not reserve a date or confirm an order.

Any separate written agreement for a custom or event order controls if it conflicts with these general terms for that order.

10. Website Content

Our original photographs, graphics, logos, and written content belong to Kendra’s Luscious Treats or their respective owners. You may share links to our website for personal use, but may not reproduce our content for commercial purposes without permission.

11. Privacy & Third-Party Services

Our Privacy Policy explains how personal information is collected and used.

Checkout, payment processing, and other website features may use third-party services. Your use of those services may also be subject to their applicable terms. We remain responsible for our obligations to you as the seller.

12. Responsibility & Consumer Rights

Nothing in these terms excludes or limits rights or remedies that cannot lawfully be excluded or limited, including applicable rights relating to defective, unsafe, misdescribed, or undelivered goods.

We do not exclude responsibility for fraud, intentional misconduct, gross negligence, or any liability that applicable law does not permit us to exclude.

13. Governing Law

These terms are governed by Michigan law and applicable federal law, without limiting any mandatory consumer protections that apply to you.

14. Changes to These Terms

We may update these terms by posting a revised version with a new “Last updated” date. Updated terms apply to future orders. An existing order remains subject to the terms agreed to when it was placed, unless we both agree otherwise.
